Mediation/Arbitration
The last method, and the most often utilized, that we offer is mediation-arbitration. This process uses both mediation and arbitration. The parties attempt mediation and if and when it appears that certain issues cannot be resolved in that process, the mediator becomes an arbitrator who, after appropriate consultation with the parties, schedules a hearing to determine the unresolved issues, hears the evidence in a fair and unbiased manner and then decides the issue. In all cases, arbitrations are governed by provincial legislation, the Arbitration Act.
